IMPORTANT LEGISLATIVE CHANGE

We would like to draw your attention to an important legislative change affecting all EASA-regulated Hungarian organizations (except air navigation services).

The latest amendment of the implementing regulation of the Hungarian Aviation Act, Government Decree No. 141/1995, which entered into force on 30.08.2024, makes it mandatory for all organizations registered in Hungary and subject to EU Regulation 2018/1139 (Basic Regulation) to use the ERCS (European Risk Classification Scheme) risk analysis methodology during the internal investigation of aviation safety occurrences.

The amended implementing regulation also makes it mandatory to transmit these risk analyses to the competent authority or accident investigation body via the ECCAIRS2 (European Incident Reporting Platform - aviationreporting.eu) platform.


CONSEQUENCES, TASKS

Organizations that have not yet converted to the ERCS methodology and/or have a different risk assessment methodology described in their handbooks (e.g. the ICAO method which has long been used by many) should immediately implement the new methodology and update their manuals.

Organizations that have so far transmitted the results of their internal occurrence investigations to the competent authority or accident investigation body by other means (e.g. email, telephone) and/or have a different occurrence reporting procedure described in their manuals should immediately modify their occurrence reporting procedures and update their manuals.

If the organization fails to do so, it commits a legal infringement, which the Authority may detect and sanction during an on-site or "desktop" audit.
